Hi,
My GC is still a far away thing for me. But I want to know this to prepare potential interview questions.
After getting a Green Card, as far as I know, if you live outside of U.S. longer than 6 months, you lose your Green Card.
Does that also apply if you are dispatched by your company (supposedly big U.S. corporation) to a overseas office for a couple years?

I am currently on H4 and it expires in a couple of months. I have my H1 approved for 2008 quota. My husband's H1 expires on sept 2007. we are applying for I-485 next month. Do i need to apply I-765 and I-131 because as per the instructions from my attorney it says the following:
-I-765 or EAD card. If you have valid H-1B valid more than one year and will not change job, you do not need EAD.
-i-131 or Advance Parole. If you have valid H-1 or H-4 visa stamping valid more than one year of if you are Canadian citizen, you do not need AP
Please clarify me whether I-765 and I-131 is required for our case.

We filed 485 on Jul 2nd. So far no receipt yet.:(
My wife's F1 status is going to expire in Aug. She needs to change her status to H4 now. Will the status change have any negative influence on our 485 application? Do we need to send some amendment regarding the COS?

All,
I am in a bit of confusion and needed some info. I had applied for I-485 during July fiasco and my spouse applied as derivative. We had applied for her H1 extension/transfer through another employer after we filed for I-485 as we did not want her to use EAD. We recently received her H-1 approval without I-94.
I am not sure at this point if she has to leave immediately to get the h1 stamp Or she can continue to stay here as her AOS is pending based on derivative status of my application.
Also will her getting approved without I-94 impact her pending AOS in anyway

The USCIS provided further clarification and instructions on I-140 premium processing following the initial announcement. They listed three types of cases that are not eligible for premium processing, even if they are within the EB3 preference category. These are:

a labor certification substitution request
a duplicate labor certification requests (i.e. those cases where the original labor certification is not included)
These cases simply have additional processing requirements that cannot be met within the premium processing timeframe. These exceptions are in addition to the EB3 �other worker� cases which, as mentioned above, are not eligible for premium processing.

I was working with employer -A till 2006 and got I140 approved (Feb 2006) in EB3. In November 2006 I joined employer B as it is good for my carrier. I talk to employer A (body shopper) and he is ready to support for my green card as I worked for him for six long years and still he did not cancel my old H1B.
1. I have two options here my old employer (A) is body-shopper. So he will agree for both future or current employment. I have very good permanent job and bright future prospects with new employer (B). In this case what you guys advice me? Apply I485 as future employment or quit present job and join old employer (A) and apply I485 as current employment?
2. If I do not join old employer (with whom I have I140 approved) now, in this case what are my options for I485 applying? (Only future employment I485/ I can file current employment I485 and not drawing any salary from old employer )
3. Will I485 as future employment has any problems?
4. Can I use AC21 after 180 days on my I485 future employment application?

My birth was regiestered under totally different first name, also DOB is off by 9 days (10th June instead of 1st June). Since the birth is registered they are not issueing non-availability cert. . What to do?
I have both parents affidavits, school leaving cert, 10th class cert, PAN card showing date/place same as that in passport. Filing a civil case in India is the option but it could take more than a year. since my PD is Sep04, my 485 could be processed within months.

Yes. One envelop for AP and the other one for EAD. Put both envelops in Fedex envelop.

You would need to take an updated affidavit of support and you latest tax returns if you have filed for any dependents and they have been called for the interview also. Would be useful for you to take the I-140 approval with you. All your original certificates, including birth and marriage, employment letter, W-2's, medicals if the ones that you submitted have expired, you need to follow the list of documents as per the interview letter. If your spouse has been called for the interview you would need to take joint documents and photographs to show that it is a bona fide marriage.

It's not clear what you really mean.
You say your employer has agreed to file your AOS papers but has not agreed to proceed with the processing. Isn't that one and the same?
Besides you should ask for exactly what the risk is.
Maybe hiring your own immigration attorney or a consult is the best to get your facts straight.
I corrected that. It is the attorney who didn't give a positive sign yet

Hi people, I am currently applying change of status from H1 to F1. Since my PERM got audit, and my h1 visa is going to expire in the end of January 2009, I need to change my status to F1 student visa in order to stay in the U.S legally. Now, I am trying to fill out the form I-539 by myself, and I got confused on:
part 4. additional information on 3g:"Have you, or any other person included in this application, been employed in the U.S. since last admitted or granted an extension or change of status?"
I don't know should I put "YES" or "NO", I have never done "i-539 for change of status" on my first F1/OPT to H1 visa....but I actually worked in the U.S...
Can anyone help me to answer that? thanks a lot!!!
