USCIS had been given strict guidelines to process all cases within a six month timeframe depending on the type of the case. But many cases have come to light which are not seeing the light of the day.
How about filing our taxes on April 16, but not on April 15.
Exactly what is your logic? There is no law against their getting delayed in completing a case in 6 months. There is a law for not submitting taxes on time. That is why I think this argument is not very valid. I can see your frustration with the delays at USCIS, however, and sympathize with it.

Hello,
I would need to apply for transit visa to fly through UK. There is a UK consulate office in ATLANTA but not sure if they would give transit visa if I go in person there? Did anyone had any experience.

I'm getting a visa stamping date in Kolkata embassy but I'm from New Delhi. I dont want to take a chance and wait till the dates in New Delhi embassy are available. Can I schedule interview in Kolkata and later when dates become available in New Delhi change it ? I mean can I change the venue of my appointment ?

I was in a similar situation last year.I had stamped my intial H1 stamps from Mumbai and Chennai. Last year in June i booked my appointment with New Delhi Embassy for stamping in Sept end when i was to be in India. i think appointments were a major issue at that point of time. Returning workers can apply for visa stamp at any consulate/embassy .

I am working for one of the largest companies as mechanical engineer. I am shifting from Mechanical engineer to program manager job within the same company. The job requirement is
BS + 2-5 years of experience
I have
Bachelors 4 Years
Masters in USA
Research Assistant 1 year 8 months
Teaching Assistant 11 months
Experience as a Mechanical engineer 3 years 8 months
Am I eligible for eb2 category? Help greatly appreciated.

Can anyone tell me after my 6th year of H1 i have a 3 year extension of h1 visa, can i go to india and come back on that visa or do i need to have AP. I got my 140 approved and i got my 485 receipt notices.
As long as you have a valid H/L visa stamped on your passport , you dont need an AP to re-enter. Refer to lot of forums at IV. you will get info about AP/EAD usage and linking with H1

Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
Effective January 4, 2010, the U.S. Department of Health and Human Services, Center for Disease Control and Prevention (HHS/CDC) is removing HIV from the list of communicable diseases of public health significance and references to HIV from the scope of medical examinations for foreign nationals.
Until the rule goes into effect, non-citizens who are HIV-positive cannot be admitted into the U.S. unless the U.S. Department of Homeland Security (DHS) grants a waiver. Once the rule goes into effect on January 4, 2010, HIV infection will no longer be defined as a communicable disease of public health significance, immigrant visa applicants who are required to undergo a medical screening exam will no longer be tested for HIV, a waiver for entry into the U.S. will no longer be necessary, and HIV-positive visa applicants will not be found ineligible for visas under Section 212(a)(1)(A)(i) of the Immigration and Nationality Act (INA). Although foreign nationals with HIV who apply for visas will no longer be ineligible under INA Section 212(a)(1)(A)(i), they still must overcome the public charge under INA Section 212(a)(4) by demonstrating to the consular officers that they will have the means of support in the U.S. and that they will not need to seek public financial assistance. My attorney office replied back to My I485 query yesterday in the overnight post(today is the last day to respond). For the marriage proof, i attached the marriage certificate which has my incorrect date of birth. I attached the affidavit describing that there is the entry error in the marriage certificate and applied for the correction and as in process with "Registrar of Marriage" office in India. In the meantime, i received the corrected marriage certificate today with the scanned copy. My question is, Can i send my corrected marriage certificate document today to USCIS ? Will they accept with one day delay?

How do you know that your case has been transferred from NSC to TSC.
Receipt has address of issuing office at the bottom of it. I also had nothing showing up in the system until yesterday, but today, our EAD's are in the system, but not I-485 or I-131. Perhaps EAD is considered a priority.

I'm not a lawyer but my Mom was in the same situation accept she had GC back in the 70's and after that she moved to India and then used visitors visa to travel back and forth (couldn't travel every year) - My understanding is that once you use visitors visa to enter the country you automatically abandon your perm resident status (even though she never physically surrendered the GC).
She is now in the process of getting another 10 year visitor visa stamp, what I plan to do after that (through a lawyer) is request for info on her existing file under "right to know" laws, that will give information on her current state of GC... and then take it from there. Since I now have GC I'm thinking it would be easier to sponsor her in a few years then going through the process of reviving her GC (if thats even possible).
Hope this helps a little! if you plan to get info on her file make sure she has a good amount of time left on her visitors visa... so she can travel back and forth.

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. Just hold on to those papers and make them available when they travel back in future.
Their Visa will not get cancelled, i have seen people coming back second time after just rejection. But ensure they leave the country ASAP
