My fianc�e lives in Mexico and I live in the United States. We are planning on getting married this summer. As soon as I return, I'm planning on beginning the process so that my future wife could come to the United States to live with me. We plan on getting married in the Catholic Church, but we have doubts if that type of marriage is a valid one for this specific situation. We just don't want a delay in the process simply because it was a religious marriage and we want to be with each other as soon as possible. My question is: Is a religious marriage valid for this situation? Which one would you recommend: Having a civil marriage or a religious marriage in Mexico?

I got hold of a copy of the actual RFE and when I read closely, the above statement sounded alarming. Since the labor was filed in 2003, I was wondering what relevance June 26, 2006 has.

I-140 approved for Employer A in January 2007 (EB2 Category)
Changed job in April 2007 to Employer B (my current employer).
I-485 filed in July 2007 using approved I-140 from Employer A, and a letter for future employment.
Employment verification RFE received in June 2009
My lawyer advises to use AC21 and provide employment verification letter from my current employer (Employer B) for this RFE response.
Since my I485 filing was based on future employment and I did not work for Employer A for 180 days after filing I-485, this causes some complexity.
AC21 invocation letters typically state that you're using AC21 for switching employment after 180 days. What argument should be used to invoke AC21 in my case?

My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?

I think you can go for stamping. Instead of Paystubs you better wait till you get your W2 and then go. But carry paystubs with you and show them if they ask.

I have read somewhere in the past that I can file I485 for this future job as the dates have now become current. Can anyone confirm this and any idea what is the general recommendation for the duration that I have to stay with this employer once I start the job.

Thanks. Yes it is within driving distance, just the city is different.
I was tensed because I didn't know the right answer.
With all the H1 issues going on nowadays because of location, I wanted to confirm.
Say when I file my H1 extension, then the employer address is the going to be the new one, in the LCA.
So was concerned if it will raise any red flags.
What do you all think?

Your Employer letter should be sufficient to support your wife from your employer,u don't need any other stuff,you can also tell your attorney about the form I-134 for Affadavit for support thats all you need,everything should be ok,don't worry be happy.

AFter FP, the LUD is because, during FP, they pull up the records or update the record with your Photo and signatures etc.
Name check is initiated after Notice is generated on ND. So it is seperate from FP.

Hi, I am currently on my 5th year H-1B visa. I have an option to stay with the same firm and they will help me apply greencard. But I am also considering an opportunity in Bermuda for a 2-3 year program (with the same firm).
My question is if I come back to the US after 2 years, will I be able to apply H-1B visa again? Will it be a whole new H-1B petition/application process subject to the H-1B cap?
Or will it be just another H-1B renewal process following my previous two terms?
Do I need to wait for another two terms of H-1B to expire before starting the greencard process?
Can I ask my currently employer to apply for greencard concurrently while I am working outside the US?

You should speak with a contract or employment lawyer in your home state about this. The rules on these agreements vary from state to state, and the agreements are often not enforceable. Even if the reimbursement agreement is enforceable, an employer can never ask an employee to pay the training fee ($1500 or $750, depending on the size of the company).

Hello, my application was filed on July 11 and reached USCIS on 12 th (TSC). Speaking to an officer at USCIS I found that my application has been rejected on Sep 11, 2007 due to missing filing fee. He said, I can try re-filing my case with that letter they sent, a letter explaining the situation (guess an apology letter from our end) and a new check. But, he did mention honoring the application would be at the discretion of the immigration officer.
I still haven't received the rejection letter yet. Has anyone been through a similar situation. If so, can you please tell me if they would honor my re-filing ? Please let me know your thoughts.
