My wife's and mine EAD renewal was applied on the 23rd of July (company lawyer delayed filing). I received mine in 30 days but my wife's case is still pending, though I am working on my H1 and don't need it. My wife's current EAD expires today, is there anything we can do to get the process to move faster or get her case expediated other than just wait till 90 days. There are lots of people I know who received their EADs even though their applications were sent much later. If the discontinuity is long, my wife may loose her job.
Please help. Many thanks.

Follow "Direct Filing" instruction by USCIS effective July 30th 2007. Did googling for "Direct filing I-765", you will get the answer. Thanks
All,
I have a question about Mailing my renewal petitions. I have talked to Texas SC few times. I got different answers each time. It appears that they all need job training.
Here is my scenario:
Originally my 485 was filed with NSC and then it was transferred to TSC. So my 485 is pending in TSC right now. Where should I mail my renewal applications?. I live in Colorado. There are 2 different views on this. Some people say that I have to send my applications to whereever my 485 is pending. Some people say that I have to mail it to NSC.
Any thoughts?/
Thanks

USCIS site has been having some trouble for the past couple of months. The reciept numbers are all valid but are not displaying any status in the system. I had the same challenge with one of my applications. So when I called the rep could also not find the status online, but then they connected me to another rep who could check all my status and confirmed that the application was in the system and even notified me of the status.
Since only the petionter can make an inquiry in the status of an H1-B application, pls work with your HR to call the USCIS and get the information. You will be fine , don't worry.

So it looks like I have 2 independent questions:
1. Can an H1B be transferred to a new company once the H1B holder is in their 6+ year?
2. Can one port their EB3 case to EB2 with a new employer?
After reading around in forums, the answer for question 2 seems to be Yes and with some successful examples.
What is still not clear is questions one.
Any help please?
Thank you

Hi ,
I attended H4 VIsa intervew recently at Chennai,India and got Green 221(G) asking for some documents from petitioner. Meanwhile my husband changed the employer and got new I797.
Now at the time of submitting the documents, I understand that I need to submit new I797. But what about the documents stated in 221(G), Do I still need to submit them? If so which petitioner's documents do I need to submit? Old one or new one? As the query was mainly about petitioner and now that the petitioner is changed , do I still need to submit them?
Please advice.

I think the only way you can know about it is by looking at Receipt notice you will get in mail. I believe every individual/case has a unique number.

Penalize in what sense?
If your marriage is a true marriage, then there will be no problem with respect to immigration even if you do not live at the same place.

If you will be getting any benefit in the volunteer position, such as experience in your profession, contacts, or other vocational benefits, I would not consider it appropriate H-4 activities. Even if you are not being paid a salary, you are getting a professional benefit and that is a reward.

1. What is the exact filing fee ? The latest I-131 instructions have this note -
NOTE: If you filed a Form I-485, Application to RegisterPermanent Residence or Adjust Status, as of July 30, 2007,no fee is required to also file a request for advance paroleon Form I-131. You may file the I-131 concurrently withyour I-485, or you may submit the I-131 at a later date. Ifyou file Form I-131 separately, you must also submit acopy of your Form I-797C, Notice of Action, receipt asevidence of the filing of an I-485 as of July 30, 2007.
My PD was current in July, and my application reached USCIS on July 2. Does this note mean I dont have to pay any fees for AP ?
2. How do I connect a new AP application to a filed 485 application ? I dont have receipt for the 485 application yet - it reached on July 2, 2007.
3. What do I fill in part 7 ? It has the following questions -
1. If the person intended to receive an advance parole document is outside the United States, provide the location (city and country) of the American embassy or consulate or the DHS overseas office that you want us to notify.
2. If the travel document will be delivered to an overseas office, where should the notice to pick up the document be sent:

My employer has asked me to take care of our office in India. I am on H1B that will expire in 2011. We have decided for me to spend 2 months in India and one month in US. The plan is to reenter US on H1B since it will still be valid.
I also have a pending 485 and i am going to let my EAD and AP timeout and stick to H1B.
Now, the question is: will this be a problem? Is there a limitation on how long an H1B holder stay outside the US while continuing to maintain status?
I am going to be travelling back to India soon but have already spent more than 5 months in india this year (onver three trips) and am wondering if there will be a problem when i come back in november.
I cant find anything on the net no this.

Just to be clear - where were you born? India or Britain? You can be a British citizen, but if you were not born there, you are counted under the chargeable area of India, not ROW.
There really is no "priveledge" that you will recieve, if you were born in the UK. As Roseball mentions, if you are ROW and can file EB2, your dates would be current when it comes time to apply for I145. If you file EB3, you'll be (currently) stuck in Retrogression at I145 stage.
FWIW - you need to maintain status in the US to retain your greencard.

I am not sure if this discussion may be opened by someone already. I could'nt find it and hence I am opening a new one.
I know its not required to have SSN for starting the job from 10/01/2007. I am eager to know if we can apply for SSN before this date or do we need to wait until Oct 1st. Thanks
