- My AP expires on 01/07/2009. How early can i apply for the renewal?

Hi guys,
We have been trying to talk to somebody consequential at the US Embassy in New Delhi because of a medical emergency. My wife and son both are in India. My son, who is a US citizen requires immediate medical assistance in US. Unfortunately, my wife does not have any visa at this moment because of some technicalities.
We are trying to contact somebody from the embassy staff who can assist us in getting an emergency visa appointment. we tried to call the numbers given on their website, but we are only able to reach low level operators who simply redirect us to another automatic voice mail number. Also, writing to their email address is not proving anymore helpful. Mostly we don't even get any reply to our emails. Sometimes we simply get some automatic response to our emails which is not at all relevant to our requests.
So if anybody has any direct number/email of some senior embassy staff, please forward it to us. It will be really helpful for us.

I am planning to complain against my employer for not paying bench pay. He says he can prove that I never reported to him. I got my status changed from H4-H1B since October2008. He already got a signed leave letter from me . Now I would like to come back to legal status. When I make a complaint to DOL how can I prove that I worked for this employer. I never visited their office personally. All the communications happened through phone and email.
We had many e-mail communications between October to till-date. Is this enough to prove my case? How can he defend himself saying that I never reported to him. I am genuine candidate with real experience and never faked my resume. I am ready to face any legal issues. Please guide me how to proceed.

You maintain H-1B status as long as there is a relationship between u and ur company. This is usually showed by paystubs. If you do not, you can apply for H-1B transfer, but then the extension of stay will most likely not be granted, as the USCIS needs to see your paystubs. I would speak to an attorney about this.

I guess it means nothing to us. My file has moved over the years from CA -> NE -> SJ NBC -> TSC.
TSC was the most efficient machinery USCIS had. Someone in NSC may not have liked this, so they are moving the old files to TSC to make it look just as bad. :D

USCIS recently issued a Memo that amends Adjudicator�s Field Manual on General Form I-140 Issues. Many issues are covered, but one of particular interest to our PERM (http://www.h1b.biz/lawyer-attorney-1135851.html)readers is the Labor Certification Validity for Labor Certifications with an Ending Validity Date that Falls on a Saturday, Sunday or Federal Legal Holiday.
DOL has established a 180-day validity period for approved labor certifications. See 20 CFR 656.30(b). An approved labor certification must be filed in support of a Form 1-140 petition during the labor certification's validity period. DOL has not published any guidance regarding the treatment of labor certifications that effectively have a validity period of less than 180 days due to an ending validity date that falls on a Saturday, Sunday, or a federal legal holiday.
USCIS will accept the filing of 1-140 petitions where the supporting labor certification validity period ends on a Saturday, Sunday or federal legal holiday on the next business day, i.e., the next day that is not a Saturday, Sunday or federal legal holiday. This action is most consistent with existing USCIS regulations, which allow cut-off dates for the filing of petitions and applications that fall on a Saturday, Sunday or federal legal holiday to be extended until the next business day. See 8 CFR 1.1 (h). This procedure provides petitioning employers the benefit of the full 180 day validity period for approved labor certifications established by DOL.

Wondering if a little something when filing my taxes will backfire on me when filing I-140/485.
I'm single/no dependents but for past 4 yrs or so when filing taxes have showed 2 dependents for child tax credit (no earned income credit applied for)....my niece/nephew. My bro had full knowledge and he had suggested as due to his status in US, he is not required to file taxes. Sis in law not working, so not filing taxes. So i used to do that....
It won't come to bite me right???? ok i am never doing this from now on but is it too late for me. Obviously on my immigation forms i will show no dependents etc as i have none...
any advice.....

Yes, you can change your employer's from India but you need to go for stamping again at US Consulate and get a new VISA to enter into US.

Your wife is fine. There is a CIS memo that specifically says that her H-4 status is not employer-specific. The only thing is that she will have a different expiration date to you. She would no get admitted for any longer than her visa, even showing your H-1B approval.
