From what I know, it is not mandatory to file AC-21 but if you think your previous employer who filed for your I-140 can create problems for you, it's safe to file AC-21. Although, your previous employer can not withdraw your I-140 by law, some employees attempt to withdraw/cancel I-140. Sometimes, USCIS behaves in an un-expected manner and they might issues a NOID on your 485. If that happens, you will have to appoint an attorney who fights for you to repeal USCIS decision. You will win in the end, but you will go through some unwanted stress and will loose some money to the attorneys. In such cases, if you have filed for AC-21, it acts as another strong point to your fight against a erroneous decision from UCSIS.

Hi,
I have a questions and recommendation request.

-> I have filled my 485 and have EAD with priority date Nov 17, 2006
-> I am planning to change job now.
-> Question is; should I file for H1 Xfer or just take my chances with EAD?
The request is for an immigration attorney that can help my new employer file H1 Xfer and AC-21.

I looked at different forums. But I could not locate a definite answer for my questions.
I have H1. My wife has H4. Both will expire in 11/2009. I don't have stamp
but she has stamp. We both used AP to enter into USA recently. We did not use our EAD.
Questions on EAD paper filing :
14) Manner of Last Entry into the U.S. ?
15) Current Immigration status ?
I believe that the answer to the question 14 should be PAROLEE or Advance Porole. How about question 15 ?
The immigration officer put 'Conditions: AOS DA' in our AP and new I-94 both. What will be the answer, AOS Pending or H1B/H4 ?
Please share your experience. Thanks in advance.

For your condition, I believe for #15 is AOS pending .. you will lose your H1/H4 status when you entered using AP.
not sure about #14, I think it's PAROLEE.

Is it possible to change to Consular processing while I-140 and I-485 is in pending.
I filed 485 in Aug and do not have the receipt either.

Hi,
I went to infopass inquiry today. Immigration agent told me on counter that my I485 is in final review stage and you don�t have to worry about I140. You can receive your GC very soon.
I filed I485 based on pending I140 with PD Jun 2004 and this is still pending. My other I180 that is approved has PD March 2008. Agent also told me that I should forget about I140 and PD. I485 cannot in Final stage if I140 is not clear. He told you should not worry about PD also because I485 cannot be in final review stage if there is PD issue.
My I485 is in EB2 category and currently USCIS is processing the cases with PD 2005 or less.
Can some please explain me that what does the Final Review stage means? Is that mean I will get GC pretty soon even my I140 and PD combination is not approved/ current.

Your Petition indicates that you r applying for Professional with Advanced Degree or exceptional Ability . According to ETA 9089 submitted with ur peition the min reeqmnts you are wiling to accept are less than MS degreee. Part H of ETA 9089 indicates employer will accept BS + 72 months of Exp.
Advanced Deg is defined by US academic of Proff or a Foreign equivalent above BS. In the alternative US BS or a foriegn equiv degree followed by at least five years of progressive experience in the speciality shall be considered equiv to MS degree. ETA 9089 did not allow for any alternative combination of Education and Experience that is acceptable.
There is no other definition of Advanced Degree. Service therefore finds that the certified ETA 9089 does not support the filing of I-140 in teh requested classification. You are therefor afforded this chance to amend yout I-140.

for the first time I/m doing self-filing could you please answer my naive questions?
1. How could I know which service center to file? I have my current EAD with me with the card and attached paper work and it says it is from Nebraska Service Center - so is this the service center I need to re apply?
2. Where can I find the mailing address for this service center?
3. Should I send a copy of my passport and other immigration history documents for renewal?
Please reply at your convenience.

My parents are planning to go for a visa interview. What is difference between me inviting them to visit me versus they applying as tourists. I understand that if they apply as tourists they need to provide documents showing that they can support themselves.
Will coming as a tourist diminish the possibility of getting 10 year multiple entry visa. Any thoughts on this issue is much appreciated.

My case was approved on Aug 19, 2010. I received my card on Aug 26, 2010.
Unfortunately, The EAD card had a wrong start date. I have sent my cards back for correction on Sept 2, 2010.
(I do have approval e-mail of my cards and the case.)
So, Question is, Can I work while my cards come back with the correct date. I don't have receipt of the replacement cards in my hand yet.
Please let me know.

US rolls out new online visa form in India

NEW DELHI - With the demand for US visas surging by the day, the US embassy and its consulates in India have introduced a new online non-immigrant visa (NIV) application form to cut out needless delays.
The DS-160 form will be online on the website of the US embassy from Jan 19. For all NIV visa appointments starting Feb 1, applicants will need to fill out the DS-160 form, the US embassy said here Wednesday while announcing the introduction of the new form.
The new form, that leverages new technologies, is expected to cut processing delays as applications could be pre-processed and pre-screened before an applicants interview.
Applicants will continue to complete visa application forms online, as they did previously with the Electronic Visa Application Form, the embassy said.
The demand for American visas has been escalating in India over the years.
The four US consulates in the country had processed 725,000 visas in 2007 - a 58 percent increase from 2006.
India is among the top 10 countries sending visitors to the US.

The fingerprinting is generally scheduled to give enough time to the personnel at the center to do their job comfortably and not have a large waiting line. From my experience I found that the scheduling is loose and so the folks at the centers can accomodate an extra person very easily. Also these are contractors who get paid by the number of cases so they are okay with doing a fingerprinting if you turn up on an unscheduled day.
The best bet is to turn up on a weekday. I did this for both myself and my wife as we were headed to India the day our fingerprinting was scheduled. There was no one in line and the whole process took at most 10 minutes.

Has anyone been able to call USCIS premium processing toll free number today and talk to an Officer. I have been unable to get to an Officer today but was able to talk before. I am wondering whether there is a limit on how many times you can call(I have called 3 times so far in 10 days) or if you can't call after so many days have passed after your application is approved.
I have been contacting to get my priority date corrected on I-140 approval. Please respond if anyone has information
